Crimmigration—the merging of criminal and immigration systems—has been widely documented in federal districts along the United States–Mexico border, where high-volume immigration prosecutions and mass-processing programs shape everyday legal practice. Far less is known about how these dynamics operate in northern border districts that do not experience the same enforcement intensity. This study examines how attorneys practicing in the Western District of Washington understand and navigate the relationship between federal criminal prosecution and immigration enforcement. Using semi-structured interviews with private criminal defense attorneys and an Assistant U.S. Attorney, the study explores how charging decisions, plea negotiations, and structural constraints between federal and state systems shape immigration consequences for noncitizen defendants. Findings show that, even outside the U.S.–Mexico border region, immigration penalties remain deeply embedded in federal criminal practice. Attorneys described how ICE detainers overriding federal release orders disrupt defense preparation, increase pressure during plea bargaining, accelerate removal on the detained docket, and destabilize families. Participants also noted that demographic disparities persist, with Latinx defendants disproportionately experiencing immigration-related consequences despite Washington’s distinct migration routes and institutional context. Based on these findings, the study recommends strengthening language access and legal navigation support, improving demographic data collection, clarifying charging practices for low-level immigration offenses, and enhancing coordination between federal and state systems.
